2. Definitions
Consumer — an individual entering into a legal transaction with a business that is not directly related to their professional or commercial activity. Platform — the website providing access to online courses. Course — digital content (training material) provided electronically after payment. Contract — a contract for the provision of electronic services consisting in granting access to the Course.
3. Main Characteristics of the Service
The subject of the contract is to provide the Consumer with access to the selected online Course (digital content) for an indefinite period (lifetime access), electronically, via the Platform. The available Courses and their description (including price) are indicated on the Platform before purchase. Access to the Course is personal and may not be transferred or shared with third parties.
4. Price and Payment Method
The Course price is indicated on the Platform and is a gross price (including tax). Payments are processed by payment operators (Stripe) via payment card or another available method. The Seller does not store the Consumer's payment data — payment processing is handled by the chosen payment operator as a separate controller/processor of the data.
5. Delivery Method and Time
Access to the Course is provided once the payment has been settled, no later than within 24 hours of receipt, to the e-mail address provided at purchase. The access account is created automatically (or an existing account is used) and is indicated in the purchase confirmation sent to the e-mail address.
6. Right of Withdrawal (14 days)
The Consumer has the right to withdraw from a distance contract within 14 days without giving any reason. The period runs from the day the contract is concluded. To exercise the right of withdrawal, the Consumer should inform the Seller (kontakt@webguys.pl) of their decision, using the withdrawal form available on the Platform or in any other unequivocal manner. Withdrawal form template: https://kursy.webguys.pl/en/withdrawal-form.
7. Loss of the Right of Withdrawal (digital content)
Pursuant to Art. 38 point 13 of the Polish Consumer Rights Act, the right of withdrawal from a contract for the supply of digital content is lost if the Seller has begun supply with the Consumer's express consent, where the Consumer acknowledged losing the right of withdrawal by giving consent, and received confirmation of the contract. This consent is given by a separate checkbox that is not pre-ticked in the purchase process. In the absence of such consent, the Consumer retains the right of withdrawal for 14 days.
8. Complaints
The Consumer is entitled to remedies for digital content not conforming with the contract under applicable law. Complaints may be submitted in writing to kontakt@webguys.pl or by phone at +44 7729 284310. The Seller will respond to a complaint within 14 days of receipt. The response is sent to the Consumer's e-mail address.
9. Out-of-court Dispute Resolution (ODR)
Consumers established in the European Union have the right to use the EU online dispute resolution platform (ODR) available at: https://ec.europa.eu/consumers/odr. The Consumer may also use out-of-court dispute resolution procedures under separate provisions.
10. Final Provisions
Contracts are governed by Polish law, subject to the mandatory provisions of the law of the country of the Consumer's habitual residence that protect consumers (Regulation (EC) No 593/2008 — Rome I). The Seller is not liable for interruptions to the Platform caused by circumstances beyond its control. Matters not regulated herein are subject to Polish law and EU law.
